1. Introduction and Acceptance
Welcome to Funded Elite. These Terms and Conditions of Service (the “Terms” or “Agreement”) constitute a legally binding agreement between you (“Client,” “User,” “you,” or “your”) and Quantum SRL, a company incorporated in Italy with registered office at Via Maira 13, Latina 04100, P.IVA 03095010595, operating under the trade name “Funded Elite” (“Company,” “we,” “our,” or “us”).
BY CREATING AN ACCOUNT, CLICKING “I AGREE,” “ACCEPT,” OR ANY SIMILAR BUTTON, OR BY ACCESSING AND/OR USING OUR SERVICES, YOU EXPRESSLY ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE LEGALLY BOUND BY THESE TERMS, INCLUDING OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST IMMEDIATELY CEASE ALL USE OF THE SERVICES.
These Terms govern the entire relationship between you and us. We prioritize clarity, integrity, and transparency. Please review this Agreement carefully before using our Services.
2. Definitions
“Account” means a User’s designated account on the Funded Elite platform, allowing the User to access the Services, view challenge status, manage personal information, and interact with the platform.
“Challenge” or “Evaluation” means the simulated trading evaluation program offered by Funded Elite that Users may purchase to demonstrate their trading competence.
“Elite Account” or “Funded Account” means the simulated trading account granted to Users who have successfully completed the Evaluation and verification process.
“Forbidden Territory” means any jurisdiction where our Services are not available, including but not limited to countries subject to applicable sanctions regimes or where local law prohibits participation.
“Intellectual Property” means all worldwide intellectual property rights, whether registered or not, including patents, copyrights, trademarks, trade secrets, trade names, service marks, logos, domain names, and all related rights.
“KYC” means Know Your Customer – the process by which we verify the identity of our clients and assess potential risks.
“Payout” or “Reward” means the performance-based compensation distributed to eligible Elite Account holders in accordance with these Terms.
“Services” means all services provided by Funded Elite, including but not limited to the Evaluation programs, the Elite Account, educational content, the website, the dashboard, and any associated tools and features.
“Simulated Environment” means the demo or virtual trading environment in which all trading activities on Funded Elite take place, using fictitious capital only.
“Trading Platform” means the third-party trading platform(s) provided as part of the Services through which Users perform their simulated trading activities.
3. Nature of Services and Legal Disclaimer
3.1 Simulated Environment Only
Funded Elite provides educational digital products, performance-evaluation programs, and simulated market environments only. All trading activities performed on Funded Elite occur entirely within virtual or demo-based simulations. No real capital is handled, processed, invested, or placed into financial markets at any time.
3.2 Not a Financial Services Provider
Funded Elite is not a broker, investment firm, financial adviser, or regulated financial services provider. We do not execute orders on any exchange or market, do not accept deposits of real funds, and do not provide investment advice. We do not operate as a broker-dealer or operate under any financial services license. All environments are strictly simulated for educational and skill-development purposes.
3.3 No Guarantee of Income
Nothing in these Terms, on the Website, or in any communication from Funded Elite constitutes a guarantee of income, profits, or financial returns. Past performance in the Simulated Environment is not indicative of future results. Any rewards or payouts are performance-based and subject to the conditions set out in these Terms.
3.4 Professional Educational Intent
The core purpose of Funded Elite is professional education and skill assessment. By entering this Agreement, the Client explicitly agrees to treat all demo accounts with the same level of professional scrutiny, discipline, and risk management as if they were live trading accounts. The educational value of our products depends on the User’s ability to simulate real-world market responsibility. Failure to apply professional risk parameters undermines the purpose of the evaluation.
4. Eligibility Requirements
4.1 Age and Legal Capacity
You must be at least eighteen (18) years of age, or the age of legal majority in your jurisdiction (whichever is higher), and have the full legal capacity and authority to enter into and be bound by these Terms.
4.2 Compliance with Local Laws
By using the Services, you explicitly represent and warrant that you have verified whether the use of our Services is legally permitted in your jurisdiction. If you reside in a jurisdiction where it is forbidden by law to use our Services, you may not enter into this Agreement or use the Services. You are solely responsible for ensuring compliance with all applicable local laws, rules, and regulations.
4.3 Forbidden Territories and Sanctions
Our Services are not available in Forbidden Territories, including but not limited to any jurisdiction subject to sanctions imposed by the European Union, the United Nations Security Council, or any other applicable sanctions regime. The Company reserves the right to update the list of Forbidden Territories at any time.
You agree that circumvention of geographical restrictions (including through the use of VPN, proxy, or any other technical means) constitutes a fundamental breach of these Terms. If at any stage it is discovered that you reside in a Forbidden Territory or have circumvented geographical restrictions, the Company is entitled to close your account immediately, forfeit all pending rewards, and deny any refund.
4.4 One Account Per User
Except upon our prior written approval, we allow only one Account per User. Creating multiple accounts is strictly prohibited and constitutes a material breach of these Terms. If additional accounts are detected, we reserve the right to block all accounts associated with the User and forfeit all related payments and rewards.
4.5 Personal Use Only
Accounts are for personal use only. You may not share, transfer, sell, or assign your Account or any rights under these Terms to any third party. You may not allow any third party to access or trade on your Account. Account management services by third parties are strictly prohibited.
4.6 Accurate Information
All information provided during registration and at any point during the relationship must be true, accurate, current, and complete. You are obligated to update us promptly of any changes to your personal information. Providing false or misleading information constitutes a material breach of these Terms.
5. Account Registration and KYC Verification
5.1 Account Creation
To access the Services, you must create an Account and provide valid, correct, and up-to-date information. The details you provide during registration (including name, email, and payment information) must match the details you provide to our designated payment service provider.
5.2 Identity Verification (KYC)
Identity verification must be completed through our designated KYC provider (currently Veriff or such other provider as we may designate). Funded Elite implements Anti-Money Laundering (AML) and Know Your Customer (KYC) policies in compliance with applicable law. You are subject to these checks at any stage, particularly upon successfully completing the Evaluation and as a condition for obtaining Elite status or receiving any payout.
We may request documentation including but not limited to: government-issued identification, proof of address, proof of source of funds, and any other information we deem necessary. We may also gather and use information about you from third-party verification services.
5.3 Video Interview
Funded Elite reserves the right, at its sole discretion, to require any User to participate in a mandatory verification interview (including video interview) at any stage of the relationship. This includes during any active Evaluation Phase, while an account is in Elite status, while a payout request is pending, or during payout processing. You acknowledge and agree that we may record the video interview for verification and record-keeping purposes.
If the Company requests an interview, you must schedule and attend such interview within five (5) business days from the date of the request. Failure to do so will result in the denial of any pending payouts, immediate cancellation of all associated accounts, and termination of the relationship.
5.4 Risk Interview
In addition to identity verification, Funded Elite may conduct Risk Interviews to ensure adherence to the Anti-Gamification Policy, verify the technical or fundamental logic behind a trader’s methodology, and confirm compliance with internal risk management protocols. Cooperation and successful completion of a Risk Interview are mandatory requirements for account progression, Elite status, or payout fulfillment.
5.5 No Acceptance Guarantee
There is no guarantee that any User will successfully complete the verification process or become eligible for an Elite Account, even if all requested information has been provided. We may refuse to continue the verification process for any reason, including but not limited to legal restrictions or commercial considerations.
6. The Evaluation (Challenge)
6.1 Nature of the Evaluation
The Evaluation is a simulated training and assessment environment where we evaluate your trading performance for the opportunity to become an Elite Account holder. During the Evaluation, you will be granted access to simulated trading tools and a demo account with fictitious capital.
You acknowledge that: (a) all trading is entirely simulated; (b) the funds provided are fictitious and do not represent any currency; (c) you have no right to possess those fictitious funds beyond the scope of their use within the Evaluation; (d) these fictitious funds cannot be used for any actual trading; and (e) you are not entitled to any payment or right in respect of those funds.
6.2 Prior Experience
You must have prior trading experience and an understanding of the Evaluation programs before purchasing a Challenge. The Evaluation is not intended for individuals with no prior experience. We encourage you to utilize educational materials to enhance your existing knowledge.
6.3 Evaluation Parameters
In order to complete the Evaluation and progress to Elite status, you must meet all trading objectives, profit targets, and risk management parameters as specified on the Website for the relevant program. The Company reserves the right to unilaterally change the parameters of Services at any time; such changes do not affect Services purchased before the change is notified.
6.4 Methodology Consistency
Participants must use consistent trading methodologies during all phases of the Evaluation. Shifting from a professional strategy to a high-risk “gambling” strategy in order to pass a phase constitutes a violation of these Terms. We look for reliability and consistency in methodology.
6.5 Data Usage
You acknowledge that we have and will retain access to all information about the simulated trades you perform. You grant us express consent to use, analyze, and share this data with affiliated entities. You agree that these activities may be performed automatically without further consent on your part, and that you are not entitled to any remuneration associated with our use of such data.
7. Elite (Funded) Account
7.1 Granting of Elite Status
If you successfully complete the Evaluation, pass the KYC/verification process, and comply with these Terms, we may offer you an Elite Account. Completing the Evaluation and verification does not guarantee acceptance as an Elite Account holder.
7.2 Ongoing Compliance
Elite Account holders must continue to comply with all trading rules, risk management parameters, and the terms of this Agreement at all times. We may apply additional risk parameters to Elite Accounts and reserve the right to modify account conditions.
7.3 Scaling Plan
Details of any scaling plan, including conditions for account growth, are published on the Website and may be updated at our discretion. Any updates apply prospectively to new trading periods.
8. Anti-Gamification Policy and Prohibited Practices
8.1 Anti-Gamification
Participants are strictly prohibited from treating the Challenge or any Funded Elite product as a game of chance rather than a professional trading environment. Users must demonstrate a “proof of skill” that is replicable in real-world trading scenarios. Approaches that rely on luck-based outcomes rather than technical or fundamental analysis are contrary to our educational mission and constitute a breach of these Terms.
8.2 Prohibited Trading Practices
You may not engage in any of the following practices:
- Hyper-aggressive position sizing, excessive “all-in” trades, or single-direction exposure without documented risk logic.
- Arbitrage-like patterns, latency arbitrage, or exploitation of price feed delays, errors, or inconsistencies in the simulated environment.
- Ultra-short-cycle executions (scalping without documented logic) designed to exploit the demo environment’s technical limitations.
- Gap trading by opening trades when major macroeconomic events are scheduled, or within 2 hours before a market closure of 2 hours or more.
- Simultaneously entering opposite positions on the same or highly correlated instruments across one or more accounts (hedging across accounts).
- Copy trading between accounts, whether your own or third-party accounts, unless expressly authorized.
- Using third-party Expert Advisors (EAs), scripts, bots, artificial intelligence, ultra-high-speed tools, or mass data entry systems that manipulate, abuse, or give an unfair advantage.
- Account management: allowing any third party to trade on your behalf, or trading on behalf of any third party.
- Trades that are not reasonably replicable in actual financial markets or that contradict how trading is performed in real markets.
- Any strategy that artificially distributes profit across multiple days without proportionally distributing market risk.
- Exploiting the simulated nature of the environment, including deliberately overloading the trading server (more than 2,000 server requests per day).
- Repeated account exploitation to “hit” a target by chance rather than skill.
- Switching trading methodologies between evaluation phases when such switching is prohibited.
8.3 General Prohibited Uses
In addition to prohibited trading practices, you may not:
- Violate any applicable law, regulation, or third-party right.
- Scrape, crawl, hack, reverse engineer, decompile, disassemble, or bypass any platform protections, security measures, or technical restrictions.
- Circumvent geographical restrictions using VPN, proxy, or any other technical means.
- Develop competing products or services using information obtained from the platform.
- Use the Services for any purpose other than personal educational and skill-assessment use.
- Sublicense, rent, distribute, sell, or transfer access to the Services in any manner.
- Submit any content containing viruses, malware, or harmful code.
8.4 Consequences of Violations
Any violation of the prohibited practices set out in this Section 8 may result in one or more of the following actions, at our sole discretion and without prior notice:
- Removal of offending simulated trades from your history.
- Restricted access to the Trading Platform.
- Disqualification from the Evaluation process.
- Forfeiture of all pending rewards and payouts.
- Immediate termination of all active Challenges and Elite Accounts.
- Permanent ban from the platform.
- No eligibility for any refund.
9. Professional Conduct and Anti-Abuse Policy
9.1 Zero Tolerance
Funded Elite maintains a zero-tolerance policy regarding the mistreatment of our staff, community, and brand reputation.
9.2 Harassment and Abuse
Any form of harassment, verbal abuse, profanity, threats, or intimidation directed toward Funded Elite employees, support agents, or representatives—via email, live chat, social media, or any other channel—will result in the immediate termination of the User’s account and a permanent ban from the Services.
9.3 Review-Based Threats (Extortion)
We do not tolerate “review-blackmail.” Any attempt to threaten the Company with negative reviews, social media defamation, or reputational harm in an effort to circumvent rules, obtain undeserved refunds, or gain unfair advantages constitutes a material breach of this Agreement.
9.4 Consequences
In the event of conduct described in this Section 9, Funded Elite reserves the right to terminate all active Challenges and Elite Accounts without notice and without eligibility for any refund.
10. Fees, Payments, and Taxes
10.1 Evaluation Fees
Fees for the Evaluation programs are listed on the Website in the applicable currency. All fees are inclusive of applicable taxes unless otherwise stated. You are responsible for any additional bank charges or currency conversion fees imposed by your payment provider.
10.2 Payment Methods
You may pay the fee for the selected program using the payment methods currently available on the Website (which may include credit/debit card, bank transfer, cryptocurrency, or other methods as offered). Payment must be made by the Account holder.
10.3 Tax Obligations
You are solely responsible for fulfilling all tax obligations in connection with the use of our Services and any rewards received, in accordance with the applicable laws of your jurisdiction. You are obligated to pay any applicable taxes or duties properly and on time. The Company does not provide tax advice.
11. Refund and Cancellation Policy
11.1 General Rule
All purchases of digital Challenges and products are final. The Evaluation fee is non-refundable once you commence trading activity on the Evaluation account.
11.2 Pre-Trading Refund
If no trading activity has occurred on the Evaluation account and you have not breached these Terms, you may request a refund within fourteen (14) days of the purchase date. All refund requests are subject to the Company’s discretion.
11.3 Fee Refund on Successful Completion
Where applicable and as specified on the Website for the relevant program, the Evaluation fee may be refunded upon successful completion of the Evaluation process and attainment of Elite status. Details are provided on the Website for each program.
11.4 No Refund Upon Breach
In the event of termination due to any breach of these Terms, you are not entitled to any refund of fees paid. Any accrued rewards or pending payouts shall be forfeited.
11.5 Chargebacks
If you initiate a chargeback or payment dispute without first contacting us to resolve the matter, this constitutes a material breach of these Terms. The Company reserves the right to immediately terminate all associated accounts and permanently ban the User from the platform.
12. Payout and Reward Distribution
12.1 Eligibility
Payouts are available only to verified Elite Account holders who have completed the KYC process, passed any required interviews, and are in full compliance with these Terms.
12.2 Payout Process
Payout requests are processed in accordance with the schedules and conditions published on the Website. We reserve the right to conduct additional verification, including Risk Interviews, before processing any payout. Payouts will be made only to accounts held in the same name as the registered User.
12.3 Right to Withhold
The Company reserves the right to delay or withhold any payout if there is a reasonable suspicion of a breach of these Terms, pending the outcome of any investigation or verification process.
12.4 Payment Method and Fees
Payouts will be processed via the methods specified on the Website. Any processing fees, currency conversion charges, or minimum thresholds applicable to payouts are as stated on the Website and may be updated from time to time.
13. Intellectual Property
13.1 Ownership
All content, materials, software, trademarks, trade names, logos, domain names, and any other Intellectual Property associated with Funded Elite are the exclusive property of the Company or its licensors. You do not acquire any ownership rights by using the Services.
13.2 Limited License
We grant you a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable right to access and use the Website and Services for your personal, internal use only, in accordance with these Terms. This license does not extend to any commercial use, reproduction, distribution, or derivative works.
13.3 Restrictions
Without our prior written authorization, you may not: reproduce, modify, adapt, translate, or create derivative works of any content on the Website; reverse engineer, decompile, or disassemble any software or technology used by the platform; use any automated tools to access, scrape, or collect data from the Website; or use our trademarks, logos, or trade names without express written consent.
14. Privacy and Data Protection
We process your personal data in accordance with our Privacy Policy, which is available on our Website and forms an integral part of these Terms. By using the Services, you acknowledge and consent to our data processing practices as described in the Privacy Policy.
We comply with the General Data Protection Regulation (GDPR) and other applicable data protection laws. You have the right to access, correct, delete, and port your personal data, and to object to or restrict certain processing activities, as detailed in our Privacy Policy.
15. Limitation of Liability
15.1 Services Provided “As Is”
THE SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE.
15.2 No Liability for Trading Losses
All trading activities on Funded Elite are simulated. The Company shall not be liable for any simulated trading losses, missed opportunities, or any decisions you make based on your use of the Services.
15.3 Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICES, REGARDLESS OF THE THEORY OF LIABILITY.
15.4 Maximum Liability
In no event shall the Company’s total aggregate liability to you for all claims arising from or related to these Terms or the Services exceed the total amount of fees actually paid by you to the Company in the twelve (12) months preceding the claim.
15.5 Platform Availability
We do not guarantee uninterrupted, error-free, or secure access to the Services. The Company is not liable for any losses or damages caused by service interruptions, system failures, maintenance, third-party platform outages, data feed issues, or force majeure events.
16. Indemnification
You agree to indemnify, defend, and hold harmless Funded Elite, its officers, directors, employees, agents, affiliates, and licensors from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from or related to: (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party right; or (e) any content you submit through the Services.
17. Termination
17.1 Termination by the Company
We reserve the right to suspend, restrict, or terminate your Account and access to the Services at any time, with or without notice, for any reason, including but not limited to:
- Breach of any provision of these Terms.
- Violation of prohibited trading practices or the Anti-Gamification Policy.
- Failure to complete KYC verification or a requested interview within the required timeframe.
- Providing false, misleading, or incomplete information.
- Suspected fraudulent activity, identity theft, or money laundering.
- Residing in or being a national of a Forbidden Territory.
- Circumvention of geographical restrictions.
- Any conduct that harms the Company, other Users, or third parties.
- Inactivity for a period of thirty (30) or more consecutive days without placing a trade.
17.2 Termination by the User
You may terminate your Account at any time by contacting us at SupportJP@fundedelite.com. Termination of your Account does not entitle you to any refund of fees paid. Any pending payouts at the time of termination will be processed only if all conditions for payout have been met and no breach of these Terms is suspected.
17.3 Effects of Termination
Upon termination, all rights granted to you under these Terms immediately cease. The Company may retain your data as required by law or for legitimate business purposes. Sections of these Terms that by their nature should survive termination shall continue in effect, including but not limited to: Intellectual Property, Limitation of Liability, Indemnification, Governing Law, and Dispute Resolution.
18. Third-Party Services and Platforms
We may utilize third-party services, platforms, and providers in connection with the Services. Your use of any third-party service is subject to the terms and conditions of that third party. We do not endorse, warrant, or assume any responsibility for third-party services, and we shall not be liable for any loss or damage arising from your use of such services.
You acknowledge that the availability of specific Trading Platforms may change and may vary by geographical location due to restrictions imposed by third-party providers. We shall not be liable for the unavailability of any specific platform in your jurisdiction.
19. Communications and Notices
You agree that we may communicate with you electronically, including by email to the address associated with your Account, by posting notices on the Website, or through in-platform notifications. All electronic communications from us satisfy any legal requirement that such communications be in writing.
Notices delivered to the email address on file shall be deemed received by you. It is your responsibility to keep your contact information current.
20. Modification of Terms
Funded Elite reserves the right to update, modify, or replace these Terms at any time in our sole discretion. Material changes will be communicated via email or a prominent notice on the Website. Your continued use of the Services after the effective date of any modification constitutes your acceptance of the updated Terms. If you do not agree with the modified Terms, you must immediately stop using the Services.
21. Governing Law and Jurisdiction
21.1 Governing Law
This Agreement and any disputes arising out of or in connection with it shall be governed by and construed in accordance with the laws of the Italian Republic, without regard to its conflict-of-law principles.
21.2 Jurisdiction
Any disputes arising from or in connection with this Agreement shall fall under the exclusive jurisdiction of the Tribunale di Latina, Italy.
21.3 Amicable Resolution
The parties agree to attempt to resolve any disputes amicably before initiating formal legal proceedings. Either party may propose mediation as an alternative dispute resolution mechanism.
22. Force Majeure
The Company shall not be liable for any failure or delay in the performance of its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, pandemics, strikes, power outages, internet disruptions, cyberattacks, or failures of third-party systems or infrastructure.
23. Severability
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, it shall be severed from these Terms. The invalidity or unenforceability of any provision shall not affect the validity or enforceability of the remaining provisions.
24. Waiver
The failure of the Company to exercise or enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by the Company.
25. Assignment
You may not assign or transfer any of your rights or obligations under these Terms without the prior written consent of the Company. The Company may assign its rights and obligations under these Terms to any affiliate or successor entity without your consent.
26. Entire Agreement
These Terms, together with the Privacy Policy and any other policies or agreements referenced herein, constitute the entire agreement between you and the Company with respect to the Services, and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written, between the parties regarding the subject matter hereof.
